Biography

Bob Dibert has investigated and litigated disputed issues for more than 35 years, including 20 years’ experience with privacy and security for data in litigation beginning with HIPAA compliance for protected health information (“PHI”) during discovery. He has assisted clients with data theft and other cybersecurity issues for more than 10 years, ranging from device theft to insider misappropriation to ransomware and other threats.

• Understanding recent federal orders, laws and guidance, including Executive Order 14028, the Cybersecurity and Infrastructure Security Agency (“CISA”) Shields Up Guidance, the Strengthening American Cybersecurity Act of 2022, proposed SEC cybersecurity rules, and federal agency decisions to exercise inspection or other discretionary authority to include cybersecurity

Biography

Michael advises clients in how to deal with all aspects of the modern information economy. As chair of Frost Brown Todd’s Privacy and Data Security team, Michael helps clients comply with the applicable laws, rules, and regulations governing the proper use and disclosure of personal information. In addition to assisting clients in investigating and addressing potential data breaches, Michael also assists clients in addressing state and federal regulations regarding health law matters.

Biography

Gene practices in the firm's litigation department. He devotes a significant amount of his time to cyber-security counseling and defending insurers in matters relating to first and third-party claims, including a variety of liability, indemnity, health, maritime, and contractual claims. Gene draws on his experience as a Rear Admiral in the U.S. Navy, recently serving on Active Duty as Deputy Commander of U.S. 10th Fleet and Fleet Cyber Command to augment his work in Admiralty and Cyber-security. While on Active Duty he led or assisted in responses to dozens of cybersecurity incidents, directly supporting U.S. Cyber Command, U.S. Navy and other agencies within the Department of Defense. He represents insurers and vessel owners on seaman's claims, Jones Act, Longshoreman and Harbor Workers' Act, and issues relating to cargo and barge disputes.
